1. Acceptance of Terms
By installing ChargebackAU from the Shopify App Store and using the app ("Service"), you agree to be bound by these Terms. If you do not agree, uninstall the app and stop using the Service.
2. Eligibility
ChargebackAU is designed for merchants whose Shopify store business address is in Australia. The app's evidence is built around Australian Consumer Law and Australian delivery practices and may not be suitable for merchants outside Australia.
3. Nature of the Service
ChargebackAU is an automated dispute-management tool that uses Artificial Intelligence (AI) to generate response evidence for chargebacks and payment disputes.
Not Legal Advice: We are a software provider, not a law firm. The evidence and responses generated by our system are for informational and administrative purposes only.
No Guarantee of Outcome: We do not guarantee that any specific dispute will be won. The final decision rests with the cardholder's issuing bank or the payment provider. You agree that ChargebackAU is not liable for lost disputes, lost revenue, or chargeback fees.
4. Authorisation to Act
By installing the app and (optionally) connecting PayPal, you authorise ChargebackAU to:
- Read order, customer, transaction, and dispute data necessary to build evidence
- Where Shopify permits, submit dispute evidence to Shopify Payments on your behalf, and prepare evidence for you to submit for PayPal disputes
- Track response deadlines and notify you of dispute activity
5. AI & Automated Content
Our Service uses generative AI to draft evidence. While we strive for accuracy, AI can occasionally produce incorrect information. You acknowledge it is your responsibility to review submissions for accuracy before they are sent. We accept no liability for errors or omissions in the evidence submitted.
6. Fees and Billing
ChargebackAU is billed through the Shopify Billing API. Plans are: Free (1 dispute/month), Starter, Growth, and Pro, charged monthly in USD. There is no success fee — you pay only the flat subscription for your tier. You can change or cancel your plan at any time from within Shopify. Fees already paid are non-refundable.
7. Limitation of Liability
To the maximum extent permitted by Australian law, ChargebackAU shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill. Our total liability for any claim shall not exceed the amount you paid us in the three (3) months preceding the claim. We are not responsible for technical failures, webhook delays, or API outages caused by third parties (e.g., Shopify, PayPal).
8. Data Privacy & Security
We use your data solely to fight disputes on your behalf and do not sell your customer data. You represent that you have the right to share your customers' personal information with us for the purpose of disputing chargebacks. See our Privacy Policy for details.
